Kenneth L. Marcus Tomorrow morning, LDB President Kenneth L. Marcus will testify on “Fighting Sexual Harassment in American Higher Education” before the U.S. Commission on Civil Rights at a federal briefing on “Enforcement of Sexual Harassment Policy at Educational Institutions by the U.S. Department of Education’s Office for Civil Rights (OCR) and the Civil Rights Division of the Department of Justice (DOJ).” This is a timely briefing in light of OCR and DOJ’s controversial recent agreement with the University of Montana. Marcus is a former Civil Rights Commission Staff Director and also previously served as the head of OCR. In those roles, Marcus developed the federal government’s policies for combating anti-Semitism in higher education. Although Marcus’ testimony will not specifically address campus anti-Semitism, many of the same principles developed in sexual harassment law are also applied to cases involving religious, ethnic or religious discrimination. The Brandeis Center has provided best practices guidance on combating harassment in higher education while protecting the freedom of speech and academic freedom.
