Congresswoman Debbie Wasserman Schultz hosted the program at the Rayburn House Office Building in Washington, D.C.

Brandeis Center Chairman Kenneth L. Marcus and Director of Corporate Initiatives and Senior Counsel Rory Lancman presented on the legal challenges used to combat civil rights violations on college campuses and in the workplace. Congressional staffers from both political parties attended to collect educational resources for their offices.

During the NYCC Committee on Higher Education hearing, Brandeis Center Alyza D. Lewin delivered powerful testimony and answered questions about the impact of BDS campaigns on Jewish students.

According to Lewin, “The reason anti-Semitism is increasing and not decreasing on campus is because university administrators are mis-diagnosing the problem. They are treating this as a speech issue rather than recognizing the marginalization, harassment and discrimination that is taking place.”

Brandeis Center President Alyza D. Lewin presented during the 'Know Your Rights' legal panel at Israel on Campus Coalition's 2022 National Leadership Summit (8/02/22).

This video captures her explanation why Title VI of the Civil Rights Act of 1964 is one of the most powerful tools to protect Jewish students on college campuses from anti-Semitic harassment and discrimination.

To combat anti-Semitic harassment and discrimination on campus, college administrators must first be able to recognize it. For that to happen, students must be able to articulate what is happening to them on campus as such — rather than a political debate.

The Louis D. Brandeis Center for Human Rights Under Law held a detailed policy briefing on the Israel-Gaza war on March 27, 2024, including how Hamas propaganda is being perpetuated on college campuses.

Panelists included Brandeis Center Chairman Kenneth L. Recently, much needed attention has been focused on the role of Diversity, Equity and Inclusion (DEI) programs in the failure of universities to adequately address anti-Semitism on campus. Corporate DEI programs require similar attention.

On 12/20/23, the Louis D. Brandeis Center for Human Rights Under Law held a nonpartisan briefing on America's corporate DEI programs that addressed employers' legal obligation to protect employees from anti-Semitic harassment and discrimination and outlined best practices for supporting Jewish employees. LDB was pleased to be joined by the Hon. Andrea R. Lucas, Commissioner of the U.S. Equal Employment Opportunity Commission.

On October 27, 2023, the Brandeis Center hosted a Capitol Hill briefing on the rise of anti-Semitism in America after Hamas’ deadly October 7thattack on Israel, and the dire need for universal adoption of the International Holocaust Remembrance Alliance (IHRA) working definition of antisemitism.

U.S. Representative and Co-Chair of the House Bipartisan Task Force for Combating Antisemitism Brian Fitzpatrick served as the event’s honorary host. Brandeis Center Founder and Chairman Kenneth L. Marcus delivered opening remarks, while Brandeis Center President Alyza D. Lewin moderated a panel discussion with Director of the National Jewish Advocacy Center Director Mark Goldfeder, Director of StandWithUs Center for Combatting Antisemitism Carly F. Gammill, and B’nai B’rith International Director of Legislative Affairs Rabbi Eric Fusfield.

Speakers discussed the consensus surrounding the exclusive adoption of the IHRA working definition of antisemitism and the rejection of all watered-down substitutes. The IHRA working definition provides examples of how anti-Zionism is used as a cover for anti-Semitism, including holding Jews collectively responsible for actions of the state of Israel or drawing comparisons of contemporary Israeli policy to that of the Nazis. Representing their respective major Jewish organizations, speakers also provided Capitol Hill staffers with examples of anti-Semitic incidents occurring across the country, with most being reported by Jewish university students. These incidents included physical, verbal, and online harassment.

Since October 7, the Department of Education has opened 48 cases tied to antisemitism at colleges and universities, mostly related to the Israeli-Palestinian conflict. Hadassah Magazine Executive Editor Lisa Hostein convenes a virtual roundtable about the antisemitic, anti-Israel abuse Jewish university students are experiencing—and what can be done to protect them.

The incidence of antisemitism in America has reached heights not seen in well over half a century. In the past year, antisemitic incidents have spiked by more than 400%, a level that FBI director Christopher Wray calls “historic.” This panel discusses how we have reached this point as a nation, how to recognize antisemitism when we see it, and how to combat it. The program discusses ways to empower individuals and communities that experience or observe antisemitism to oppose it, including through education, allyship, legislation, and litigation. Importantly, there is a discussion as to how to combat antisemitism in a fashion consistent with the protections afforded other groups, and respecting the protections afforded by the first amendment.

A Webinar with Denise Katz-Prober, Director of Legal Initiatives at The Brandeis Center

Wednesday, November 8th (Noon EST, 11AM CST, 9AM PST)

Brandeis Center Director of Legal Initiatives Denise Katz-Prober will discuss the escalation of existing campus antisemitism following the 10/7 Hamas massacre, the law available to protect students from a hostile environment, and the steps that can be taken to protect students’ rights. Title VI of the Civil Rights Act of 1964 bars discrimination by universities and grade schools that receive federal funds. Jewish students are protected under our civil rights laws from harassment and discrimination and cannot be denied access to educational opportunities on the basis of their shared Jewish ancestry and ethnicity. The Brandeis Center, a civil rights legal advocacy organization, supports students on campus by using legal tools to address anti-Semitic harassment and discrimination, including filing Title VI complaints with the Department of Education’s Office for Civil Rights (OCR). OCR can then investigate and impose corrective actions on schools that fail to address hostile environments and other forms of discrimination.

Rachel Lerman discusses the complaint LDB co-filed with the Anti-Defamation League to the U.S. Department of Education’s Office for Civil Rights against the Berkeley Unified School District (BUSD). The federal complaint cites BUSD for failing to take action to end nonstop bullying and harassment of Jewish students by peers and teachers since Oct. 7, 2023. Board Member Tevi Troy, referenced Brandeis Center Chairman Kenneth L. Marcus’s
insights on the importance of exclusively using the IHRA Definition to define anti-Semitism.

Host John Podhoretz mentioned that any enshrined definition of anti-Semitism allows
anti-Semitic individuals to successfully discriminate against Jews by maneuvering around the definition. In response, guest Tevi Troy noted that: “From a philosophical perspective, that makes sense. But our friend Ken Marcus has written about this issue, and he’s worked at the [U.S.] Department of Education, and he says [that] without a definition, the bureaucrats at the Department of Education, the people that enforce the laws against discrimination, they cannot pursue cases of discrimination.They just let it lie there, because they say the don’t know how to address it. So if you want to have the federal government go after people who are anti-Semitic or have the federal government stop spending money on anti-Semitic programs, of if you want to have the federal government say that there are things that are forbidden, you need to have some kind of definition. And if you’re going to have definitions, I’d rather have the IHRA Definition…over this very mealy-mouthed, wishy-washy Nexus definition.”
